INVITATION TO BID
The National Library of the Philippines (NLP), through the FY 2013 General Appropriations Act of the Government of the Philippines (GOP)in coordination with the Department of Public Works and Highways intend to apply the sum of Six Million Two Hundred Thousand Pesos (PhP6,200,000.00) being the Approved Budget for the Contract (ABC) to payments under the contract for the Continuation of Retrofitting of National Library of the Philippines Building Columns and Restoration of its Affected Areas. Bids received in excess of the ABC shall be automatically rejected at bid opening.
The National Library of the Philippines (NLP) now invites bids for Continuation of Retrofitting of National Library of the Philippines Building Columns and Restoration of its Affected Areas. Completion of the Works is required within 120 calendar days.
Bidding will be conducted through negotiated procurement as provided in the Revised IRR of RA 9184 Article XVI, Section 53.4. Bidding is restricted to Filipino citizens/sole proprietorships, partnerships, or organizations with at least seventy five percent (75%) interest or outstanding capital stock belonging to citizens of the Philippines.
The National Library of the PhilippinesProcuring Entityreserves the right to accept or reject any bid, to annul the bidding process, and to reject all bids at any time prior to contract award, without thereby incurring any liability to the affected bidder or bidders.

ADOPTION OF NEGOTIATED PROCUREMENT FOR THE CONTINUATION OF THE
STRUCTURAL RETROFITTING OF THE NATIONAL LIBRARY OF THE PHILIPPINES
WHEREAS, the Structural Retrofitting of the National Library Building Ground Floor Columns including Restoration of the Affected Areas is a result of competitive bidding, thus Resolution No. 12-09 made on December 18,2012 and contract were made and executed last January 23,2013 by the National Library of the Philippines (NLP) represented by Director Antonio M. Santos and Global-V Builders, Co. represented by Mr. Lawrence C. Lim, President. (Annex A);
WHEREAS, Director Antonio M. Santos approved the Purchase Request for the Continuation of the Structural Retrofitting of the National Library Building Specifically the Ground Floor Columns including the Restoration of the Affected Areas. (Annex B);
WHEREAS, on October 10, 2013, the Bureau of Construction of the Department of Public Works and Highways (DPWH), under Director Walter R. Ocampo, who’s Office is directly assisting NLP for this project submitted the Program of Works (POW) and Detailed Cost Estimate for the proposed continuation of the project. (Annex C);
WHEREAS, the attached certification dated October 18,2013 (Annex D), further justify that the said amount is really intended for the retrofitting of the additional eight (8) columns of NLP building;
WHEREAS, on October 24,2013, Ms. Fe B. Basagre, Finance and Administrative Division Officer In-charge, requested the Bids and Awards Committee (BAC) to prepare the necessary documents for the bidding of the continuation of the retrofitting project of NLP ground floor columns chargeable to the savings generated in the release of allotment for the Retrofitting Project amounting approximately to Six Million Two Hundred Thousand Pesos (P6,200,000.00) as stated in the attached letter. (Annex E);
WHEREAS, Section 53.4, Article XVI of the IRR of RA 9184, states that “Where the subject contract is adjacent or contiguous to an on-going infrastructure project and provided however that (a) the original contract is the result of a competitive bidding; (b) the subject contract to be negotiated has similar or related scopes of work; (c) it is within the contracting capacity of the contractor; (d) contractor uses the same prices or lower unit prices as in the original contract less mobilization cost; (e) the amount involved does not exceed the amount of the ongoing project; (f) the contractor has no negative slippage/delay. Provided, further, that negotiations for the procurement are commenced before the expiry of the original contract;
WHEREAS, in the evaluation, BAC considered all the factual circumstances of the foregoing and the immediate need to resolve the procurement of the project before the expiry of the contract in November 28,2013 which necessitates the use of alternate method specifically negotiated procurement;
WHEREAS, on motion, a motion unanimously seconded, it was;
RESOLVED, as it is hereby resolved, that the use of negotiated procurement for the aforesaid retrofitting project is justified ans is recommended for approval of the Director as Head of the Procuring Entity, by reason of the existence of the conditions set forth by the IRR of the RA 9184 and in line with the promotion of economy and efficiency in the procurement system, this November 5,2013.
